Who Pays? When Damage to Your Home is Caused by a Third Party

There are times when water damage to your home is caused by a third party. We've been to homes in which a new refrigerator was incorrectly installed, causing the water line to leak. Or the oil company accidentally overfills your tank - causing a biohazardous mess in your basement. Maybe a plumber made a mistake when working on your pipes. In many of these cases, the company responsible voluntarily offers to cover the restoration costs. However, there may be times when that offer doesn't come and you may wonder - who pays for the damage- your insurance company, you or the third party?

Subrogation, by definition, is when an insurance company seeks payment or restitution from a third party that caused damage or injury to an insured person or property. Usually this means your insurance company will try to recover payments from the insurance company covering the party at-fault.
